TERMS AND CONDITIONS – ONLINE STORE

These general conditions are an integral part of the travel program presented on our website, constituting, in the absence of an autonomous document, the travel contract.

The information is binding on the agency unless cumulatively:

  • The program expressly provides for it;
  • Changes to it are insignificant;
  • Information about the change is provided to the traveler in a durable medium;
  • These general conditions comply with the provisions of Decree-Law No. 17/2018 of March 8.

The General Conditions whose object is an Organized Trip or Connected Travel Service included in the program, the corresponding standardized information sheets, and the particular conditions contained in the travel documentation provided to the Traveler at the time of booking the trip constitute the travel contract binding the parties.

  1. Organization

1.1 The organization of the trips included on this website and their commercialization is the responsibility of J C B Rent – Rent A Car Lda, headquartered at Rua José Dias da Costa, No. 128, 4780-279 Lama, VAT: 507343654, with a share capital of €50,000.00, telephone (+351) 214156072 (cost of a call to the national landline network), email geral@tourism.jcbrent.com.

  1. Registrations

At the time of registration, the Traveler must deposit a percentage of the service price of up to 40% (as informed at the time), settling the remaining 60% up to 31 days before the start of the service. If registration takes place 31 days or less before the service start date, the total price must be paid at the time of registration. J C B Rent – Rent A Car Lda reserves the right to cancel any registration whose payment has not been made under the aforementioned conditions. Reservations are subject to confirmation from suppliers of all services.

  1. Information under law no. 144/2015 of September 8

Under Law No. 144/2015 of September 8 in its current wording, we inform that the Traveler may resort to the following Alternative Dispute Resolution Entities:

i) Customer Ombudsman of Travel Agencies and Tourism at www.provedorapavt.com;
ii) Arbitration Commission for Tourism of Portugal at www.turismodeportugal.pt;

  1. Complaints

4.1 Any non-compliance in the execution of a travel service included in the organized travel contract must be communicated to the organizing or retail travel agency in writing or by other suitable means as soon as such non-compliance occurs, i.e., without undue delay.

4.2 The right to file complaints for the purpose of price reduction or right to compensation for non-compliance with the travel services included in the organized trip expires within 2 years.

  1. Baggage

5.1 The agency is responsible for the baggage under legal terms;

5.2 The Traveler has an obligation to complain to the service provider at the time of theft, deterioration, or destruction of baggage.

5.3 In international transport, in case of baggage damage, the complaint must be made in writing to the carrier immediately after the damage is detected, and within 7 days of its delivery at most. In the case of mere delay in baggage delivery, the complaint must be made within 21 days from the date of delivery.

5.4 The presentation of such a complaint will be essential grounds for triggering the agency’s liability against the service provider.

  1. Limits

6.1 The agency’s liability will be limited to the maximum amount payable to service providers under the Montreal Convention of May 28, 1999, on International Air Transport, and the Bern Convention of 1961, on Rail Transport.

6.2 Concerning maritime transport, the liability of travel agencies, regarding their Travelers, for the provision of transport services, or accommodation, if applicable, by maritime transport companies, in case of damages resulting from their willful misconduct or negligence, shall be limited to the following amounts:
a) € 441,436, in case of death or bodily injury;
b) € 7,881, in case of total or partial loss of baggage or its damage;
c) € 31,424, in case of loss of motor vehicle, including baggage contained therein;
d) € 10,375, in case of loss of baggage, whether accompanied or not, contained in a motor vehicle;
e) € 1,097, for damage to baggage, resulting from damage to the motor vehicle.

6.3. When applicable, the liability of travel agencies for the deterioration, destruction, and theft of baggage or other items, in tourist accommodation establishments, while the Traveler is staying there, is limited to:
a) € 1,397, overall;
b) € 449 per item;
c) The value declared by the Traveler, regarding items deposited for safekeeping with the tourist accommodation establishment.

6.4. The agency’s liability for non-bodily harm is contractually limited to three times the price of the service sold.

  1. Reservation and Change Expenses

7.1 For each reservation, the following reservation expenses will be charged: €10.00

7.2 Change Expenses: For each change (names, dates, type of apartment or room, trip, etc.): €15. Please note that the acceptance of such changes depends on acceptance by the respective suppliers.

8. Documentation

8.1. The Traveler must have in good order their personal or family documentation (identity card, military documentation, authorization for minors, visas, vaccination certificate, and any other documentation required). The agency declines any responsibility for the refusal to grant visas or the non-permission of entry to the Traveler in a foreign country; the Traveler shall also bear all costs resulting from such situation.

8.2. Travel within the European Union:

Travelers (regardless of age) traveling within the European Union must possess the respective civil identification document (Passport; ID card, Citizen Card);
To obtain medical assistance, they must hold the respective European Health Insurance Card;
Nationals of non-EU countries should consult specific information regarding the documentation required for travel with the embassies/consulates of their countries of origin;
8.3. Travel outside the European Union:

Travelers (regardless of age) traveling outside the European Union must possess the respective civil identification document (passport) as well as the visa if necessary (obtain such information from the agency at the time of booking);
Nationals of non-EU countries should consult specific information regarding the documentation required for travel with the embassies/consulates of their countries of origin;

  1. Changes requested by the traveler

9.1. If the suppliers of the relevant travel permit, whenever a Traveler, registered for a certain trip, wishes to change their registration to another trip or to the same one with a different departure date, or any other change, they must pay the above-mentioned fee as change expenses. However, when the change occurs within 21 days or less before the departure date of the trip for which the Traveler is registered, or if the service providers do not accept the change, the Traveler is subject to the expenses and charges provided for in the “Contract Termination by the Traveler” clause.

9.2. Once the trip has started, if changes to the contracted services are requested for reasons not attributable to the agency (e.g., extension of stay nights, flight changes), the prices of tourist services may not correspond to those published in the brochure that motivated the contracting.

  1. Assignment of Registration (contractual position)

10.1. The traveler may transfer their position, being replaced by another person who meets all the conditions required for the organized trip, provided that they inform the travel agency in writing, up to seven consecutive days before the scheduled departure date.

10.2. The assignor and the assignee are jointly responsible for the payment of the outstanding balance and for any fees, charges, or additional costs arising from the assignment, which shall be duly informed and evidenced by the travel agency.

  1. Changes to be made by the agency

11.1. Whenever, before the start of the organized trip, (i) the travel agency is obliged to significantly change any of the main characteristics of the travel services, (ii) or cannot meet the special requirements requested by the Traveler; (iii) or proposes an increase in the price of the organized trip by more than 8%, the traveler may, within 7 days:
a) Accept the proposed change;
b) Terminate the contract, without any penalty, being refunded the amounts paid;
c) Accept a replacement organized trip proposed by the travel agency, being refunded in case of price difference.

11.2. The lack of response from the Traveler within the deadline set by the travel agency shall imply tacit acceptance of the proposed change.

  1. Contract Termination by the Agency

12.1. When the trip depends on a minimum number of participants, the Agency reserves the right to cancel the organized trip if the number of participants reached is below the minimum. In these cases, the Traveler shall be informed in writing of the cancellation within:
a) 20 days before the start of the organized trip, for trips lasting more than six days;
b) 7 days before the start of the organized trip, for trips lasting two to six days;
c) 48 hours before the start of the organized trip, for trips lasting less than two days.

12.2. Before the start of the organized trip, the travel agency may also terminate the contract if it is prevented from executing it due to unavoidable and exceptional circumstances.

12.3. The termination of the travel contract by the agency as described above only entitles the traveler to a full refund of payments made within a maximum period of 14 days after the termination of the travel contract.

  1. Price Change

13.1. The prices in the program are based on the costs of services and exchange rates in effect at the time of printing of this program, and are therefore subject to changes (increase or decrease in price) resulting from variations in the cost of transport or fuel, taxes, fees, and currency fluctuations up to 20 days before the travel date.

13.2. If the increase exceeds 8% of the total price of the organized trip, the provisions of the “CHANGES TO BE MADE BY THE AGENCY” clause shall apply.

13.3. In case of price reduction, the travel agency reserves the right to deduct from the refund to be made.

14. Debit or Credit Card Payments

You can make payments for the services booked on this website by credit or debit card, through our secure payment pages. All payments made by this method are debited from your account at the time you finalize your purchase.

15. Refunds

Once the trip has commenced, no refund is due for services not used by the Traveler due to force majeure or causes attributable to the Traveler, except for refunds by the respective suppliers. Failure to provide services included in the travel program due to causes attributable to the organizing agency, and if it is not possible to replace them with equivalent ones, entitles the Traveler to be refunded the difference between the price of the planned services and the services actually provided.

16. Termination of Contract by the Traveler

16.1. The traveler is free to withdraw from the trip at any time before the start of the trip.

16.2. Such termination implies that the traveler is responsible for payment of all charges resulting from the commencement of the contract and its termination, minus the reassignment of services and cost savings.

16.3. Where applicable, the Traveler shall be reimbursed the difference between the amount paid and the amounts referred to above. In this situation, the refund shall be made, after deducting the charges, within a maximum period of 14 days from the termination of the travel contract.

16.4. The traveler also has the right to terminate the travel contract before its commencement without paying any termination fee, if unavoidable and exceptional circumstances occur at the destination or its immediate vicinity significantly affecting the performance of the trip or the transport of passengers to the destination. Termination of the travel contract in this situation only entitles the traveler to a full refund of the payments made.

17. Liability

17.1. The travel and tourism agency is responsible for the proper execution of all travel services included in the travel contract.

17.2. In the case of package holidays, travel and tourism agencies are responsible to travelers, even if the services are to be provided by third parties and without prejudice to the right of recourse, under the applicable general terms.

17.3. Organizing travel and tourism agencies are jointly liable with retail agencies in the case of package holidays.

17.4. In other travel services, the travel and tourism agency is responsible for the correct issuance of accommodation and transport tickets and also for the negligent choice of service providers, if they were not suggested by the traveler.

17.5. The travel and tourism agency acting as intermediaries in the sale or reservation of standalone travel services is responsible for the issuance errors of their respective tickets, even in cases resulting from technical deficiencies in the reservation systems attributable to them.

17.6. The travel and tourism agency is responsible for any errors due to technical deficiencies in the reservation system attributable to them and, if they have accepted to make a reservation for a package holiday or for travel services that are part of connected travel services, for errors made during the reservation process.

17.7. The travel and tourism agency is not responsible for reservation errors attributable to the traveler or caused by unavoidable and exceptional circumstances.

18. Assistance

18.1. In case of traveler’s difficulties, or when, for reasons not attributable to them, they cannot complete the organized trip, the travel and tourism agency will provide the following assistance:
a) Provision of adequate information about health services, local authorities, and consular assistance; and
b) Assistance to the traveler in making remote communications and finding alternative travel solutions.

18.2. If the difficulty that grounds the request for assistance has been caused by the traveler deliberately or negligently, the travel and tourism agency may charge a fee equal to the costs it incurred in providing such assistance.

18.3. If, due to unavoidable and exceptional circumstances, the traveler cannot return, the organizing travel and tourism agency is responsible for ensuring the necessary accommodation costs, if possible of equivalent category, for a period not exceeding three nights per traveler. The retail travel and tourism agency is jointly responsible for the obligation, without prejudice to the right of recourse, under the applicable general terms.

18.4. The cost limitation provided above does not apply to persons with reduced mobility, nor to their companions, pregnant women, unaccompanied children, or persons requiring specific medical care, provided that the travel and tourism agency has been notified of these specific needs at least 48 hours before the start of the organized trip.

19. Insolvency

In case of insolvency of the travel and tourism agency, the traveler may resort to the Travel and Tourism Guarantee Fund, for which they must contact Turismo de Portugal I.P, the entity responsible for its activation.

20. Insurance

20.1. The liability of the organizing travel agency and the selling agency arising from the obligations assumed is guaranteed by civil liability insurance with Allianz Insurance Company, policy no. 201518576, in the amount of €6,000,000.00 and under the terms of the applicable law.
20.2. The agency also offers the sale of insurance that can be purchased based on the trip to guarantee situations of assistance and cancellation expenses.

21. VAT

The prices mentioned in this program already include Value Added Tax at the current rate of 23%.

22. Validity

The programs presented on our website are valid until the last return date of each trip.

NOTES

These general conditions may be supplemented by any other specific ones provided they are duly agreed upon by the parties. The prices of the programs are based on the average dollar exchange rate, so any significant deviation from this currency may result in a review of the travel prices under the terms set forth in the “Price Change” clause. Due to the constant fluctuations in fuel prices, there may be changes in the fuel supplement included in the price under the terms set forth in the “Price Change” clause. The hotel and cruise categories presented in this brochure follow the quality standards of the host country, and they may be changed to similar ones when, for reasons beyond the agency’s control, it is not possible to maintain or confirm the existing reservation, obliging the agency to inform the Traveler as soon as such information becomes available.

GENERAL INFORMATION

ARRIVAL OR DEPARTURE TIMES
Departure and arrival times are indicated in the local time of the respective country and according to the schedules of the respective airlines as of the date of printing of this program, and therefore, they may be subject to change.

HOTELS/APARTMENTS
Apartments – In the case of accommodation being contracted in an apartment, it is the responsibility of the Traveler to inform the number of people who will occupy the apartment. In case more people show up than reserved, apartments may refuse entry. Hotels – The price quoted is per person and is based on double occupancy. Not all hotels have triple rooms, and an extra bed is usually placed, which may not be of identical quality. In rooms equipped with two beds or a double bed, the triple room may consist only of those beds. The list of hotels and apartments included in the programs is indicative, as well as their category, which complies with local criteria and classifications, which may sometimes differ from those used in Portugal.

MEALS
Unless otherwise stated, the prices presented for Half Board and Full Board supplements do not include beverages. Upon arrival at the hotel after 7 p.m., the first meal service will be breakfast the following day; on the last day, and unless there is the possibility of late check-out, the hotel’s last service will be breakfast.

CHECK-IN AND CHECK-OUT TIMES
The check-in and check-out times on the first and last day will be defined based on the first and last service. As a rule, without any binding character, rooms can be used from 2 p.m. on the day of arrival and must be vacated by 12 p.m. on the day of departure. In apartments, check-in usually takes place by 5 p.m. on the day of arrival, and they must be vacated by 10 a.m. on the day of departure.

SPECIAL CONDITIONS FOR CHILDREN
Given the diversity of conditions applied to children (destination and supplier), it is recommended to always inquire about the special conditions that may apply to the specific trip.
